<h2>$270 Million Lawsuit Filed Against Da Vinci Surgical Robot</h2>
<p>Another personal injury claim was filed this week against Intuitive Surgical&#8217;s Da Vinci Sugical Robot. According to the $270 million claim, the Da Vinci Sugical Robot was to blame for injuries sustained during a botched hysterectomy. The claim further alleges that Intuitive Surgical&#8217;s overly aggressive marketing practices are responsible, in part, the Da Vinci Sugical Robot&#8217;s rapid growth in popularity among physicians and patients.</p>
<p>According to the personal injury claim, &#8220;Defendant sold it [sic] device through a calculated program of intimidation and market management, forcing hospitals and physicians to purchase it in order to appear to be competitive, and creating a fear in their minds that if they did not have this technology they would lose business to competitors.&#8221;</p>
<p>The injury lawsuit, filed by 43 year old Patricia Mayfield, states that Dr. Virginia Nelson ,of the Nelson Center for Women in Meridian Mississippi, allegedly gave her marketing brochures and documents &#8220;propounding the benefit of the <b>Da Vinci Surgical Robot</b> assisted hysterectomy over all other methods of hysterectomy.&#8221;</p>
<p>According to the claim, Mayfield was admitted back into the hospital, less than 1 week after the <i>Da Vinci Surgical Robot</i> assisted hysterectomy, with a fever and &#8220;shaking chills.&#8221; Physicians treated Mayfield for pelvic abscess along the vaginal cuff. According to Mayfield, she was forced to endure a subsequent surgery to evaluate the abscess and continues to have pain years later.</p>
<h3>Training Standards and Marketing Tactics for Da Vinci Surgical Robot Called Into Question</h3>
<p>Mayfield&#8217;s lawsuit accuses Intuitive Surgical of suppressing patient complaints and hiding complication rates associated with the <u>Da Vinci Surgical Robot</u> from the U.S. Food and Drug Administration (FDA) and the public. 			<content:encoded><![CDATA[<p>According to Florida Highway Patrol (FHP) reports, Victoria Mann, of Sarasota, was critically injured this morning after being struck from behind while driving a scooter.  According to the FHP report, Mann was driving a scooter northbound on U.S. 301 close to Whitfield Ave when her scooter was struck from behind by 26 year old Jubal Gordon also from Sarasota.</p>
<p>The report indicates that a vehicle traveling behind Gordon failed to stop and struck Gordon&#8217;s vehicle as well.  The report states that the driver of the third vehicle fled the scene of the accident.</p>
<p>Mann was transported to Blake Medical center and is listed in critical condition. Although Gordon was not injured in the accident, he was charged with careless driving.</p>

The recall notice states that the pool slides can deflate during use, allowing the user to strike the ground or pavement underneath the slide, increasing the risk of injury or death.</p>
<p>The CSPC has confirmed that a 29 year old mother died from the injuries she sustained after fracturing her neck sliding down a Banzai inflatable in-ground water pool slide that had been placed over the concrete edge of a pool deck. The Banzai slide has partially deflated, causing the woman to hit her head at the bottom of the slide.</p>
<p>The CPSC, Walmart and Toys R Us are aware of other injuries that occurred in a similar manner, including a 24 year old man, in Springfield, MO who became a quadriplegic and an Allentown, PA woman who fractured her neck.</p>
<p>The recalled Banzai inflatable water pool slides are designed to be used with in-ground pools. The slides are vinyl with a blue base, yellow sliding mat, and an arch that goes over the top of the slide. On both sides of the Bonzai pool slide are the words &#8220;Banzai splash&#8221; in a circular (shaped like a wave) blue, orange and white logo.</p>
<p>The recalled slides, which were manufactured in China by Manley Toys, Ltd, were sold at Walmart and Toys R Us nationwide from January 2005 through June 2009 for about $250. The recalled slides have the barcode number 2675315734 and model number 15734. Both the barcode and model number appear on the original packaging but are not on the actual slide.</p>
<p>CPSC urges consumers to immediately stop using the product and return it to the nearest Walmart or Toys R Us for a full refund. Consumers can also cut the two safety warning notices out of the slide and just return that portion. For additional information from Walmart, call (800) 925-6278 between 7 a.m. and 9 p.m. CT Monday through Friday, or Toys R Us, call (800) 869-7787 between 9 a.m. and 9 p.m. ET Monday through Saturday and between 10 a.m. and 7 p.m. Sunday.</p>

According to the recall notice there have been 17 reported incidents of children falling through the trampoline netting that has resulted in numerous injuries, including broken bones, neck and spine injuries, and contusions.</p>
<p>The recall involves the Sportspower BouncePro 14&#8242; Trampoline. This trampoline is surrounded by brown netting measuring about 6 feet high on the perimeter of the trampoline. The UPC codes of 68706404210, and 68706404244 are printed on the trampoline box. &#8220;Sportspower BouncePro 14&#8243; and &#8220;TR-14-63-A&#8221; are printed on a plate on the leg of the trampoline frame.</p>
<p>The recalled trampolines were sold exclusively at Walmat stores, nationwide, from February 2009 through February 2012. Consumers should stop using the trampolines immediately and contact Sportspower to receive replacement black netting for the trampoline. The claim was filed, in the U.S. District Court for Northern Alabama, by Gwendolyn Jones and Amos Jones Jr. The lawsuit claims that the <b>Da Vinci Surgical Robot</b> was responsible for a botched hysterectomy. According to court documents, the <i>Da Vinci Surgical Robot</i> assisted hysterectomy left Gwendolyn Jones with significant damage to her bladder and left ureter.</p>
<p>The lawsuit further claims that Intuitive Surgical fraudulently marketed a defective medical device. &#8220;Defendant sold it [sic] device through a calculated program of intimidation and market management, forcing hospitals and physicians to purchase it in order to appear to be competitive, and creating a fear in their minds that if they did not have this technology they would lose business to competitors,&#8221; the Jones&#8217; lawsuit claims.</p>

<h2>Man Claims Da Vinci Surgical Robot Responsible for Daughter&#8217;s Death</h2>
<p>According to numerous media reports, the father of a deceased woman has filed a lawsuit against Intuitive Surgical, Inc. in the U.S. District Court for the Southern District of New York. Intuitive Surgical, Inc. is the maker of the <b>Da Vinci Surgical Robot</b>, a complex robotic device that is gaining wide popularity among surgeons. The lawsuit was filed by Rheingold, Valet, Rheingold, McCartney &amp; Giuffra LLP of New York City on behalf of Gilmore McCalla.</p>
<p>The complaint shows that McCalla&#8217;s daughter, Kimberly McCalla, had a <i>Da Vinci Surgical Robot</i> assisted hysterectomy at Montefiore Medical Center on August 12, 2010. Following the hysterectomy, Kimberly McCalla had three additional emergency surgeries before she died on August 25, 2010. McCalla&#8217;s case claims that his daughter&#8217;s death was caused by burns to an artery and her intestines sustained by the <u>Da Vinci Surgical Robot</u>.</p>
<p>McCalla&#8217;s case claims that the Da Vinci Surgical Robot is a defective medical device. The claim alleges that monopolar energy, used by the Da Vinci Surgical Robot, is not a safe as other methods currently available that would reduce risks and complications. Another allegation from the lawsuit claims that the robotic device has inadequate insulation around the arms which allows for electrical currents to affect tissue outside of the surgical operation area.</p>
<p>McCalla&#8217;s case also alleges that Intuitive Surgical failed to properly research the Da Vinci Surgical Robot or to warn patients or physicians of the substantial risk of injuries or surgical complications. McCalla&#8217;s case also accuses complaint also alleges that Intuitive Surgical has purposely hidden reports from the FDA related to complications and performance errors related to the Da Vinci Surgical Robot.</p>
<h3>Da Vinci Surgical Robot Training Standards and Marketing Tactics Under Fire</h3>
<p>McCalla&#8217;s case also calls training standards for surgeons on the Da Vinci Surgical Robot into question. According to McCalla&#8217;s cout documents, &#8220;Intuitive Surgical does not adequately train physicians nor proctor them properly on the use of its device, thereby inducing them to cause complications and injuries which would be avoided in the hands of properly trained physicians.”</p>
<p>The marketing tactics of Intuitive Surgical are also attacked in McCalla&#8217;s lawsuit. It is widely know that Intuitive Surgical marketed heavily on the internet directly to potential consumers. 			<content:encoded><![CDATA[<p>According to Florida Highway Patrol (FHP) reports, a Sarasota man was seriously injured following a motorcycle accident on Bee Ridge Road in Sarasota.  The FHP report states that 28 year old Bradley R. Williams, of Sarasota, was driving his Harley Davidson motorcycle eastbound on Bee Ridge Road at approximately 6:00 a.m.  Williams was approaching the entrance of McDonalds at 3828 Bee Ridge Road when 25 year old Jennifer D. Honea, heading westbound on Bee Ridge Road, turned in front of Williams.  Honea&#8217;s Hyundai struck Williams&#8217; motorcycle.</p>
<p>Williams was transported to Blake Medical Center with serious injuries.  Honea was not injured in the crash.  The FHP report indicates that Honea received a &#8220;violation of right of way&#8221; citation.</p>

			<content:encoded><![CDATA[<p>The U.S. Consumer Product Safety Commission (CPSC), in cooperation with One World Technologies Inc., has announced a recall of the 87,600 STOK Island and STOK Quattro gas grills. The recall is being initiated due to a defective propane gas regulator. The regulator can leak propane gas which poses a fire and burn hazard to the operator or anyone standing near the gas grill. To date, One World Technologies Inc. is aware of 569 reports of regulators leaking propane gas.</p>
<p>The recall involves the Island and STOK Quattro gas grills. The STOK Island gas grill has a round grill base and two burners. &#8220;STOK&#8221; is written on the grill cover and a label on the bottom of the grill stand. The STOK Quattro gas grill is a rectangular, four-burner grill. &#8220;STOK&#8221; is printed on the grill&#8217;s lid. To identify whether a specific Island or Quattro grill is included in this recall, you will need to look at the grill&#8217;s regulator. The recalled grills have regulators on them with the model number &#8220;AZF&#8221; on the front and a date code between 1046 and 1143 on the back of the regulator.</p>
<p>The recalled gas grills were sold nationwide at Home Depot and Direct Tools Factory Outlet stores, from March 2011 through February 2012 for between $79 and $350.</p>

			<content:encoded><![CDATA[<p>A two vehicle collision at the intersection of Honore Avenue and Proctor Road claimed the life of a Sarasota woman and seriously injures another.  According to Florida Highway Patrol (FHP) reports, a Chevrolet Impala, driven by 47 year old Diane C. Koprowski was heading east on Proctor Road around 8:55 p.m.  The FHP reports indicate that Koprowski failed to obey a flashing red light, striking a southbound Ford Explorer driven by 58 year old Dixie Ann Gallagher.</p>
<p>The collision caused the Explorer to overturn.  Gallagher, a Sarasota resident, was pronounced dead at the scene.  Gallagher&#8217;s passenger, 80 year old Mavis Jeannie Burton, was taken to Blake Medical Center with serious injuries.  Koprowski was treated at the scene for minor injuries.  FHP cited Koprowski for failing to obey a flashing red light.</p>

<p>Michelin North America, Inc. has announced a recall of three models of truck tires. The recalled tires have a casing that may experience a loss of integrity and, in some cases, have a blow out or rapid loss of air pressure. If the truck is in motion, this could result in injuries due to a vehicle crash.</p>
<p>Michelin is expected to provide information, to customers, on how to obtain replacement tires on or around April 30, 2012.</p>
<p>The tires listed in the recall include:</p>
