GlaxoSmithKline Sued Over Alleged Avandia Injuries
A group of 94 people have filed a lawsuit against GlaxoSmithKline, the maker of Avandia. The lawsuit, consisting of 14 counts, is seeking $700,000, including court costs, legal fees and other relief. In some cases, the plaintiffs are representing their deceased relatives.
The plaintiffs allege that GlaxoSmithKline should not have sold Avandia without warning about the serious side effects associated with the controversial drug. These side effects include heart attacks and congestive heart failure.
Avandia, also known as rosiglitazone, is a popular anti-diabetic drug. Avandia is most commonly prescribed to treat Type-2 diabetes. It was approved for diabetes treatment, by the U.S. Food and Drug Administration (FDA), in 1999. Since that time, an estimated 60+ million Avandia® prescriptions have been written.
The lead plaintiff in the lawsuit, Barbara Meier, and 93 other plaintiffs filed suit on May 19th in St. Claire, Illinois against GlaxoSmithKline and McKesson Corporation. The plaintiffs allege that they were prescribed Avandia for treatment of Type II diabetes that resulted in serious injury. The plaintiffs also allege that GlaxoSmithKline and McKesson were aware that Avandia was linked to a 51 percent increased risk of cardiovascular problems.
Despite their awareness of the increased risk, the plaintiffs allege that both GlaxoSmithKline and McKesson failed to issue box label warnings about the dangers associated with Avandia. The Avandia labels were changed on August 14, 2007 and again on November 19,2007 to include a warning about potential heart related risks.
The plaintiffs further claim they suffered cardiovascular injuries, such as congestive heart failure and heart attacks, endured pain and suffering, incurred medical expenses, lost significant wages due to being unable to work and suffered permanent disability and disfigurement.
